Please read these Terms carefully because they are a binding agreement between You and The Diamond Classic, LLC (“The Diamond Classic” or “We”). These Terms govern your use of the websites that link to these Terms. In these Terms, the word “Sites” refers to each of these websites and the services offered on those Sites. You automatically agree to these Terms and to our Privacy Statement simply by using or logging into the Sites. Please note that we offer multiple services. Your use of The Diamond Classic products or services may be pursuant to a separate manually or digitally-executed agreement. Those additional terms become part of your agreement with us, if you use the services or log into the Sites.
1. Eligibility and User Accounts
To use our services or enter any events, individuals must be at least 18 years of age or have the express consent and supervision of a legal guardian. By creating an account or registering for any services or events, you represent and warrant that all information you provide is true, accurate, current, and complete. You agree to maintain and promptly update your information to keep it accurate and complete.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts for any misuse, fraudulent activity, or violation of these Terms, at our sole discretion.
2. Event Registration, Payments, and Fees
All entry fees, nomination fees, sidepot fees, and associated charges must be paid in full at the time of registration, unless otherwise stated in writing. Registration is not considered valid until full payment is received and confirmed. Fees are non-refundable and non-transferable, except in cases explicitly stated in official event policies or authorized in writing by an officer of The Diamond Classic.
We reserve the right to adjust entry fees, add-on charges, late fees, or promotional discounts at any time prior to the closing date of any event. Participants are responsible for reviewing and understanding all applicable charges before registering. The Diamond Classic is not responsible for errors in payment or duplicate submissions made by the User.
3. Changes, Cancellations, and Force Majeure
The Diamond Classic reserves the right to modify, postpone, reschedule, or cancel any event or service at its sole discretion due to inclement weather, acts of God, governmental orders, safety concerns, technical limitations, insufficient participation, or other reasons beyond its control. In such cases, The Diamond Classic will make reasonable efforts to notify affected parties in a timely manner.
Refunds or credits will not be issued due to cancellation or delay caused by force majeure or conditions beyond our reasonable control. Participants are strongly encouraged to plan accordingly and understand the inherent unpredictability of outdoor and equine events.
4. Payouts and Tax Requirements
All payouts and prize money are distributed in accordance with published event rules and verified final results. Payouts will not be issued until a completed and signed IRS Form W-9 (or W-8BEN for non-U.S. residents) is received. Participants are solely responsible for submitting correct tax information and keeping their mailing address up to date.
Winnings are typically issued by check and mailed to the address on file. The Diamond Classic is not responsible for lost, stolen, misrouted, or delayed mail due to postal error or incorrect participant information. If a check is not received, the participant must complete and submit a Missing Check Form before a reissue will be considered. A replacement fee may apply.
5. Horse Nominations
Horse nominations submitted to The Diamond Classic are considered final once processed. Nomination fees are non-refundable, and nominated horses are eligible for lifetime participation under the terms outlined at the time of nomination. It is the responsibility of the horse owner or agent to ensure that all submitted information, including registration documents and ownership records, are accurate and complete.
The Diamond Classic may request verification of horse identity and ownership at any time. Misrepresentation of horse details or falsification of records may result in disqualification and permanent exclusion from future events without refund.
6. Conduct and Disqualification
All participants, spectators, and affiliates are expected to behave respectfully, ethically, and in accordance with event rules and equine welfare standards. Abuse of animals, staff, volunteers, other competitors, or property will not be tolerated.
The Diamond Classic reserves the right to disqualify any individual, withhold winnings, or ban future participation for any behavior deemed inappropriate, threatening, unethical, or in violation of published rules. No refund shall be provided in the event of disqualification.
7. Assumption of Risk and Liability Waiver
Participation in equine events involves inherent risks, including the risk of serious injury, property damage, or death. By attending or participating in any Diamond Classic event, you acknowledge and accept all such risks, whether foreseeable or not.
You agree to hold harmless and release The Diamond Classic, LLC, its owners, employees, sponsors, contractors, venue partners, and affiliates from any and all claims, damages, liabilities, injuries, or losses arising from your participation or presence at any event, including those caused by the negligence of the released parties.
8. Use of Media and Name
By entering a Diamond Classic event or service, you grant The Diamond Classic, LLC a perpetual, worldwide, royalty-free license to use your name, likeness, horse name, competition results, and any photos, video, or other media taken at the event for promotional, advertising, or commercial purposes, including in print, broadcast, or digital media.
You agree that The Diamond Classic may share or publish such materials without additional approval or compensation.
9. Privacy and Data Use
The Diamond Classic respects your privacy and handles your personal information in accordance with applicable laws and our Privacy Policy. We do not sell your personal data to third parties. However, we may share necessary information with event partners, sponsors, or software platforms (such as timing and scoring systems) strictly for purposes directly related to your participation in events.
By using our services, you consent to the collection and limited sharing of your data as required for operational purposes.
10. Intellectual Property
All content on our websites, including but not limited to logos, graphics, text, databases, software, and trademarks, is the exclusive property of The Diamond Classic or its licensed partners. You may not reproduce, modify, copy, sell, distribute, or exploit any content from our website or materials without express written permission.
Use of our digital services for unlawful, fraudulent, or competitive purposes is strictly prohibited and may result in legal action.
11. Modifications to Terms
The Diamond Classic reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website, and continued participation in our events or services constitutes acceptance of the revised terms. It is your responsibility to review these Terms periodically.
12. Governing Law and Disputes Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to any conflict-of-law principles. Any disputes arising from or relating to this Agreement, including disputes over participation, payment, liability, or intellectual property, shall be resolved exclusively in the courts located in Tarrant County, Texas.
By using our services, you consent to the jurisdiction and venue of these courts and waive any objections to such forum.
13. Entire Agreement and Severability
These Terms and Conditions, together with any event-specific rules and policies, constitute the entire agreement between you and The Diamond Classic. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
